Electrocution

Electrocution may occur if a worker plugs in a machine with a worn plug or exposed wire. The current may contact the worker and flow through him. If the worker is standing in water while operating a machine the current may travel from the machine's wire through the water to the worker. Workers injured by electrocution should contact a lawyer at the firm to seek compensation for injuries.

Workers' Compensation Claim

The worker may obtain compensation for injuries through the Workers' Compensation program. This is a no-fault program which will provide the worker with compensation for medical bills and a benefit for living expenses. Where the worker has suffered permanent injury, a lump sum benefit is awarded. It must be noted though that these benefits are quite inadequate for a person who has suffered serious injury.

Personal Injury Claim

It is to the worker's advantage to pursue a personal injury claim in the courts in addition to the Workers' Comp claim. With this claim the worker may obtain full compensation including pain and suffering. The personal injury claim however must be against third parties other than the employer unless the employer is guilty of intentional misconduct.

A third party claim could be leveled at a manufacturer selling a machine with defective wiring or plugs. A manufacturer may be also held responsible for failure to warn of using the machine while in water. Should the machine belong to another company other than the employer, a claim for negligence may be brought against the other company for poor maintenance of the machine wiring.

Finally the employer may be liable for intentional misconduct if in willful non-compliance with a Cal-OSHA order (California Occupational Safety and Health Administration) to fix the wiring of the machine.
